These General Terms and Conditions (GTC) apply to all services and products offered by Fotowaschbaer, a sole proprietorship operated by Franz Robert Berger, Feldstrasse 32, 9445 Rebstein, Switzerland. By placing an order or making a booking, you agree to these terms.

Fotowaschbaer offers outdoor, equestrian, and event photography services, private photography sessions, digital photo sales, and print products. Detailed service descriptions, pricing, and conditions are available on the website and within each service listing.

All photography bookings are submitted via the website and confirmed by email. A booking becomes binding upon email confirmation by Fotowaschbaer.

For event photography, a deposit may be required no later than one month before the event date. The remaining balance is due within 3 business days after the event.

For photography sessions, full payment is due at the time of booking confirmation or as specified in the booking confirmation email.

Cancellation terms are defined individually for each service and are displayed during the booking process. Please refer to the specific cancellation policy shown for your selected service. General cancellation inquiries can be directed to [email protected].

Payments are processed securely via Stripe. We accept credit/debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, TWINT, and bank transfers where available. All prices are displayed inclusive of applicable taxes, which are calculated at checkout based on your billing address.

Purchased digital photos are licensed for both personal and commercial use. The customer receives full usage rights for the purchased images, including the right to use them for personal projects, social media, print products, and commercial purposes.

Due to the nature of digital content, digital photo purchases are non-refundable once the download link has been delivered. By completing your purchase, you consent to immediate delivery and acknowledge the loss of your right of withdrawal for digital content.

Digital photos are delivered via a secure, time-limited download link sent to the email address provided at checkout.

All photographs are protected by copyright under Swiss law (URG) and international copyright conventions. The photographer (Franz Robert Berger / Fotowaschbaer) retains copyright and moral rights to all images.

The photographer retains the right to use all photographs for portfolio display, marketing, and promotional purposes, unless the customer explicitly requests otherwise in writing at the time of booking.

Customers who purchase digital photos receive a broad usage license as described under 'Digital Products'. This license is non-exclusive and transferable.

Fotowaschbaer's liability is limited to the value of the booking or order in question. This limitation does not apply to damages caused by willful misconduct or gross negligence.

Fotowaschbaer is not liable for non-performance or delays caused by events beyond reasonable control, including but not limited to natural disasters, severe weather, illness, pandemic restrictions, road closures, or other force majeure events. In such cases, Fotowaschbaer will offer rebooking or a full refund.

Fotowaschbaer takes all reasonable precautions to ensure equipment reliability. In the unlikely event of complete equipment failure, liability is limited to a full refund of the booking amount.

These terms are governed by the laws of Switzerland, in particular the Swiss Code of Obligations (OR). The exclusive place of jurisdiction is Rebstein SG, Switzerland, unless mandatory consumer protection regulations of the customer's country of residence provide otherwise. For EU consumers, mandatory provisions of EU consumer protection law (including the Consumer Rights Directive 2011/83/EU) remain applicable.
